What is Medical Malpractice Insurance and is it covered? 

Medical Malpractice Insurance (also known as medical negligence) is a type of insurance that covers claims against a healthcare professional that may have been negligent in their treatment of a client and caused them physical or mental harm.

Those who require Medical Malpractice Insurance may provide the following treatments/services:

•    Dispensary services
•    Medical Treatments
•    Medical procedures including surgery
•    Cosmetic treatments
•    Medical training or supervision
•    Manufacturing and distribution of medical devices or medicines

Cover that may be provided under professional body membership (for example; BMA, RCS, RCGP, CSP etc) covers you as an individual and does not extend to work you may complete through an umbrella company (as the employer).


If you perform the above tasks in your role and you need to work through an umbrella company, it is important that you check the insurance requirements with your agency.  


NASA provide the following insurances for contractors: Employer’s Liability, Professional Indemnity and Public & Products Liability cover.

NASAs insurances specifically
exclude Medical Malpractice cover which means medical professionals cannot register and be employed under our Umbrella Service (this excludes Allied Healthcare Professionals - see below).

Please note – Allied Healthcare Professionals (for example Occupational therapists, Physiotherapists, Podiatrist, Dieticians etc) are covered under NASAs insurance policy as Medical Negligence is not normally required for their work tasks..

We can also cover Nurses (PI, PL, EL) providing you work for an NHS Trust, Care or Residential Home - domiciliary care (in home) cannot be covered. We will need proof of your RCN or NMC membership upon joining Nasa Umbrella. 

Nurses / Doctors/Surgeons who provide medical advice, prescribe medicines/drugs are still not covered

 

How is Medical Malpractice different from Public Liability and Professional Indemnity? 


Public liability is all about accidental injuries and property damage – for example, haphazard events like slips, trips and falls.

Professional indemnity covers situations where someone has suffered a financial loss. 

Medical Malpractice Insurance covers claims that a healthcare professional was negligent in their treatment of a client and caused them physical or mental harm.
