Statutory Adoption Pay - SAP
As an employee of Nasa Umbrella, you are by law entitled to certain statutory benefits like Statutory Adoption Pay (SAP)
Statutory Adoption Leave is 52 weeks, and it’s made up of Ordinary Adoption Leave (first 26 weeks) and Additional Adoption Leave (last 26 weeks).
Only 1 person in a couple can take adoption leave. The other partner could get paternity leave instead.
If you get adoption leave, you can also get paid time off work to attend 5 adoption appointments after you’ve been matched with a child.
Statutory Adoption Pay (SAP) is paid for up to 39 weeks. If you qualify you get:
- 90% of your average weekly taxable earnings for the first 6 weeks
- £187.18 or 90% of your average weekly taxable earnings (whichever is lower) for the next 33 weeks.
Adoption leave can start:
- up to 14 days before the date the child starts living with you (UK adoptions)
- when the child arrives in the UK or within 28 days of this date (overseas adoptions)
- the day the child’s born or the day after (if you’ve used a surrogate to have a child)
In order for you to qualify to receive SMP you must meet the following criteria:
- You are classed as an employee
- You have given your employer (Nasa Umbrella) the correct notice (within 7 days after you have been matched with a child)
- You earn on average at least £125 a week (before tax)
- You have worked for and been paid by Nasa Umbrella continuously for at least 26 weeks by the week you were matched with a child
- You have given your employer (Nasa Umbrella) proof of adoption or surrogacy (please see below what we require)

For us to assess your eligibility we will require proof of the adoption which must show the following:
- Your name and address and that of the adoption agency
- The match date (matching certificate)
- The date of placement (letter from the adoption agency)
- The relevant UK authority’s ‘official notification’ confirming you’re allowed to adopt (overseas adoptions only)
- The date the child arrived in the UK - for example a plane ticket (overseas adoptions only)
You must also sign a form SC6 if you’re adopting from overseas with a partner. This confirms you’re not taking paternity leave or pay.

If you qualify to receive SAP through Nasa Umbrella, we will provide you with a payment schedule. If we cannot pay SAP to you, we will provide a competed SAP1 form explaining why. This form will also allow you to make a claim for Adoption Allowance directly from your local Jobcentre Plus.
